1. Scope

These General Terms and Conditions (GTC) apply to all deliveries by Haarpigmentierung MHS UG (haftungsbeschränkt) (hereinafter “we” or “Modern Hair Loss Solution”) to consumers via our online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

3. Conclusion of Contract

3.1. The presentation of products in our online shop does not constitute a legally binding offer, but merely an invitation to place an order.

3.2. By clicking the “Buy Now” button, you submit a binding order for the goods listed on the order page. Your purchase contract is concluded once we accept your order by sending an order confirmation via email immediately after receiving your order.

4. Right of Withdrawal

4.1. If you are a consumer (i.e. a natural person placing the order for purposes that are outside your trade, business, or profession), you have a statutory right of withdrawal in accordance with the applicable legal provisions.

4.2. If you exercise your right of withdrawal as a consumer under clause 4.1, you will bear the standard costs of returning the goods.

4.3. For full details on the conditions and legal consequences of your right of withdrawal, please refer to our separate Withdrawal Instructions. You can also conveniently exercise your withdrawal via the “Withdraw from contract” section in your account.

5. Prices and Shipping Costs

5.1. The prices stated on the product pages include statutory VAT and other price components.

5.2. Applicable shipping costs will be clearly communicated to you on the respective product page, in the shopping cart, and on the order page before you complete your order. Above a certain order value, we ship free of charge within Germany; the exact threshold is displayed in your shopping cart.

5.3. No further taxes or costs apply, except for any import charges on deliveries to countries outside the EU (see clause 6.3).

6. Delivery

6.1. Shipping is carried out by DHL to the countries selectable on the order page.

6.2. The estimated delivery time will be communicated to you on the respective product page and during the ordering process.

6.3. For deliveries to Switzerland, please note that the stated price does not include Swiss import duties. Swiss VAT and customs clearance fees may apply upon import and are to be borne by the recipient.

7. Payment

7.1. Payment is processed via our payment provider Stripe. You may choose from the following payment methods: SEPA Direct Debit, credit/debit card, Google Pay, and Apple Pay.

7.2. Your chosen payment method will be charged as part of the order process. For further information on the processing of your payment data, please refer to our Privacy Policy.

8. Retention of Title

The delivered goods remain our property until payment has been made in full.

9. Warranty for Defects

9.1. We are liable for defects in accordance with the applicable statutory provisions, in particular Sec. 434 et seq. of the German Civil Code (BGB).

9.2. An additional guarantee for the goods delivered by us only exists if it has been expressly stated in the order confirmation for the respective item.

10. Dispute Resolution

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
